Terms of Service

1. Acceptance

These Terms are a binding agreement between you and [LEGAL ENTITY NAME] ("LessCal", "we", "us"). By creating an account or using the service you accept them. If you do not agree, do not use LessCal. You must be at least [16] years old.

2. What LessCal is

LessCal is a nutrition-tracking tool. You photograph a meal and our AI estimates the foods, portion sizes, calories and macronutrients, then records them in your diary. It also offers food search, barcode scanning, manual entry, water and weight tracking, and AI-generated meal plans and recipes.

3. Not medical advice

LessCal is a general wellness and information tool. It is not a medical device, and nothing in it is medical, nutritional or health advice. Calorie targets are estimates produced by a standard formula (Mifflin-St Jeor) from the details you enter — they are not a prescription.

• Always consult a qualified professional before starting a diet or changing your nutrition, especially if you are pregnant or breastfeeding, are under 18, have diabetes, kidney or heart disease, a history of eating disorders, or take medication affected by diet.
• Never disregard professional advice or delay seeking it because of something you read in LessCal.
• If you are struggling with an eating disorder, calorie tracking may be harmful. Please seek support.

4. Accuracy of AI estimates

Food recognition and portion estimation from a photograph are inherently approximate. Hidden ingredients, oils, sauces, density and depth cannot be measured from an image. Treat every number as an estimate, not a measurement. You can adjust any entry. We do not warrant that estimates are accurate, complete or suitable for any medical, clinical or allergen-related purpose. Never rely on LessCal to determine whether a food is safe for an allergy or intolerance.

5. Your account

• Give accurate information and keep it current.
• Keep your password confidential; you are responsible for activity under your account.
• One account per person. Do not share, sell or transfer it.
• Tell us promptly at support@lesscal.app about unauthorised use.

6. Free trial and free tier

• New users get a [3]-day free trial of Premium. A payment method is required to start it.
• Unless you cancel before the trial ends, it converts automatically into a paid subscription at the price shown at signup.
• Without a subscription you keep a free tier: [3] AI photo scans per day, plus unlimited food search, barcode scanning and manual entry.
• We may change free tier limits with reasonable notice.

7. Subscriptions and billing

• Premium is billed monthly in advance and renews automatically until cancelled.
• Prices are shown in your local currency at signup and vary by market. Taxes may be added where applicable.
• Payments are handled by Stripe. We never receive your full card number.
• If a payment fails we may retry and may suspend Premium until it succeeds.
• We may change prices with at least [30] days' notice. Changes never affect a period you have already paid for, and you may cancel before they take effect.

8. Cancellation and refunds

• Cancel any time from your account settings. Cancellation stops the next renewal.
• You keep Premium until the end of the period you have already paid for.
• Except where the law requires otherwise, payments are non-refundable and we do not refund partial periods.
• EU/UK consumers: you have a statutory 14-day right of withdrawal. By starting the service immediately you ask us to begin during that period; you may still withdraw and we will refund proportionally for what remains unused.
• [BRAZIL: the Código de Defesa do Consumidor gives a 7-day right of regret for online purchases — confirm the wording for the BR market.]

9. Affiliate program

• Affiliates earn [70]% of the first payment and [20]% of each recurring payment from users they refer.
• Attribution is first-touch, via a cookie lasting [30] days.
• Commissions are paid [MONTHLY] once the balance reaches [MINIMUM PAYOUT], after any refund or chargeback window has closed.
• Prohibited: spam, misleading claims about results, bidding on our brand terms, self-referral, cookie stuffing, or implying you are LessCal.
• We may withhold commissions and close accounts that break these rules.

10. Acceptable use

You agree not to:

• Upload photos containing other people without their consent, or anything unlawful, hateful or sexual.
• Reverse-engineer, scrape, or resell the service, or use it to build a competing product.
• Access it with bots, or attempt to bypass free-tier limits, rate limits or security.
• Overload our infrastructure or our providers' APIs.

11. Your content

You own your photos and diary entries. You grant us a limited, worldwide, royalty-free licence to host, process and display them solely to operate the service for you — including sending photos to our AI provider for analysis. This licence ends when you delete the content or your account, except for copies retained in routine backups for a limited period. You confirm you have the right to upload what you upload.

12. Our intellectual property

The LessCal name, logo, software, design and content are owned by us and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the service under these Terms. No other rights are granted.

13. Third-party services

LessCal relies on third parties including Google (Gemini AI), Open Food Facts and Stripe. Their terms govern their services and we are not responsible for them. If a provider changes or discontinues its service, LessCal features may change accordingly.

14. Availability

We aim to keep LessCal available but do not guarantee uninterrupted service. We may modify, suspend or discontinue features. If we discontinue a paid feature materially, we will give notice and a pro-rata refund for the unused paid period.

15. Termination

You may delete your account at any time. We may suspend or terminate your account if you breach these Terms, if required by law, or if your use poses a risk to us or other users. On termination your licence ends immediately; your data is handled as described in the Privacy Policy.

16. Disclaimer of warranties

To the fullest extent permitted by law, LessCal is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be error-free, secure, or that estimates will be accurate.

Some jurisdictions do not allow these exclusions, so they may not apply to you. Nothing here removes your statutory consumer rights.

17. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the [12] months before the claim, or (b) [USD 50].

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.

18. Governing law and disputes

These Terms are governed by the laws of [JURISDICTION], and disputes will be resolved in the courts of [VENUE]. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.

19. Changes to these Terms

We may update these Terms. For material changes we will give at least [30] days' notice by email or in the app. Continuing to use LessCal after they take effect means you accept them; if you do not, cancel before that date.
